HSN - Supervisor’s Occupational Health & Safety Certificate Program Are your Supervisors competent? Do they know the Occupational Health and Safety Act? Employers must appoint a competent supervisor and in doing so, the employer must ensure the candidate “be qualified through knowledge, training and experience...and be familiar with the OHSA.” Why? Because incompetence has consequences: up to $25,000 in personal fines (per incident); up to $100,000 in corporate fines; and possibly a federal charge of ignoring due diligence under Bill C4%, a charge which comes with greater fines and possible jail time for the individual and the corporation. An increasing number of supervisors are being prosecuted and fined in workplaces across Ontario for breaking health and safety laws. Many didn’t see it coming having no idea of their roles and responsibilities under the Occupational Health and Safety Act (OHSA). The Ontario Ministry of Labour makes it quite clear that “ignorance is not an acceptable defense in the court of law.” You can’t simply say, “Sorry; I didn’t know.” The OHSA defines a supervisor as “a person who has charge of a workplace or authority over a worker.” The Act goes on to say that the supervisor must “take every precaution reasonable in the circumstances for the protection of the worker.” Many supervisors are promoted from within or brought into the company with no specific training.
